TRUE THE VOTE SUES ST. LUCIE COUNTY, FL OVER 'BOTCHED' ALLEN WEST CONTEST

- Brandon Darby

After one of the most expensive congressional races and recounts of 2012 between Rep. Allen West (R) and now Rep. Patrick Murphy (D), Houston-based True the Vote has committed to exposing exactly what happened in St. Lucie County--including hauling Elections Supervisor Gertrude Walker into federal court.

True the Vote filed a federal lawsuit against Walker, the controversial election administrator, for failure to comply with federal law. The Motor Voter law of 1993 grants the right to inspect election records, and ought to allow True the Vote to perform a “comprehensive, third-party audit” of the recount, the group claims.Vote-counting in St. Lucie County, according to both the lawsuit and local press accounts, was deeply troubled, involving considerable confusion and missed deadlines in the original tabulation and subsequent recount.

Thus far, Walker has failed to comply with True the Vote’s requests to inspect the election records. The request included, among other things, all records of Walker ensuring non-citizens and ineligible voters did not participate in the Congressional election.

True the Vote Founder and President Catherine Engelbrecht outlined the importance of this lawsuit, stating:

"This dramatic recount was an extraordinary example of how our elections can suffer systematic failure. We run the risk of seeing episodes like this becoming ordinary if citizens do not demand answers and hold election officials accountable. The American people own the voting system--we have the right to ask tough questions when we witness the failure of one of America’s core functions.”A key demand by the national election integrity watchdog is a request that the federal court order the St. Lucie County Supervisor of Elections to “preserve all election records, in whatever form, relating to the 2012 Federal general election for Florida’s 18th Congressional District,” according to the text of the lawsuit.

AMERICANS ARE VOTING WITH THEIR WALLETS ON GUNS

AWR HAWKINS

No matter where you look, the news is the same--guns are flying off the shelves, bulk ammo can't be found, and applications for concealed permits are going up, up, up.
In short, Americans have weighed in on the gun debate and the winners are the right to keep and bear arms and the duty of self-defense.
Just look at Florida, the state in which the huge national push for concealed carry began in earnest in the late 1980s. In 2012, in the Sunshine State, the number of background checks for gun purchases was 797,970. Which is 200,000 higher than it was in 2011, and double what it was in 2004.
And the trend is actually toward a higher number in 2013. Florida set a state record in December 2012 with 131,103 background checks in that one month alone.
At guns shows from Virginia to California--yes, California--the story is the same as well: people are flooding into gun shows at a record pace. On January 5 alone, 6,000 people"filed through the Ontario Convention Center" in California by the afternoon. That figure is "more than double" the number that was expected to attend the entire two-day gun show.
And in other states across the union--states as divergent as ColoradoOregon,GeorgiaPennsylvania, and North Carolina--concealed permit applications are skyrocketing.
The bottom line: gun control politicians ensconced behind the wall of protection afforded them by armed guard upon armed guard are completely out of touch with the average American father who understands it's his duty to protect his family from danger; they can't relate to the single mom who sleeps with a .38 Special close at hand because she must protect her kids in the night; and they have nothing in common with the elderly couple whose home is no longer in the good part of town, and who fall asleep every night wondering if the gun shots they hear are getting closer.
But Americans understand. And right now, they're expressing their views on such things by buying guns and ammo, then meeting the legal requirements for concealed carry in their respective states.
If we are to be free, we must be armed.

8,000 PEOPLE PACK GUN SHOW IN FLORIDA

'They're buying as fast as they can get them'

(CLICKORLANDO) — Nearly 8,000 people attended the first day of the Florida Gun Shows’ exhibition this weekend in Orlando, according to event organizers.

Crowds broke records on Saturday, and organizers said it’s possible they’ll see even larger numbers of gun enthusiasts before the weekend ends.

Hundreds of gun buyers took vouchers that would allow them to return on Sunday because it was difficult to get into Saturday’s events.

“[Gun enthusiasts] are buying and they’re buying as fast as they can get them,” said Victor Bean, promoter for Florida Gun Shows. “We’ve had some exhibitors who had to cancel because they didn’t have any inventory from their gun shops.”

Attorney Larry Klayman Fires Back Filing Motion

For  Emergency Rehearing In Florida Electoral Challenge
Plaintiff's Reply In Support Of Expedited Motion For Rehearing

Plaintiff Michael Voeltz, by and through his undersigned counsel, hereby files his Reply in Support of Expedited Motion for Rehearing on an emergency basis, as time is extremely short before the electoral college votes on January 6, 2013.

First, Defendant Obama's "argument" that Plaintiff did not request a hearing is absurd and frivolous. Indeed, in Plaintiff's Emergency Response to the Court's Order of December 13, 2012 it states plainly that he did request a hearing and once Plaintiff filed the Motion for Temporary Injunction, an evidentiary one as well. However, the court’s hastily crafted precipitous Order Dismissing Complaint was an obvious attempt to extinguish Plaintiff's right to any hearing, evidentiary or otherwise.

Second, contrary to the potentially politically motivated decisions of three judges of this Court, Section 102.168, Florida Statutes, plainly provides that Plaintiff does have a right to contest eligibility and candidate fraud in this Court.

Third, the role of the Electoral College is not in lieu of Florida law but complimentary to Florida law. It is axiomatic and constitutionally sacrosanct that states have rights; this should come as no surprise to anyone who has read the Florida and U.S. Constitutions, in particular in the 10th Amendment. The state obviously has a right and a duty to police candidacy fraud and ineligibility before its voters are lead down the primrose path to voter nullification by dishonest candidates for either state or federal office. In this case, involving defendant Barack H. Obama, federal law does not take precedence over clear cut unambiguous, and black letter Florida statutory law for the following reasons: [...] - Hat tip George Miller @ OBC2012.
